BlocBoy JB has officially filed a lawsuit against Fortnite creators Epic Games for the use of his dance moves, according to a report published by TMZ on Wednesday (Jan. 23)

In the popular game, players are able to purchase dances (known as "emotes") for their characters and the in-game "Hype" dance is directly derived from the 2018 XXL Freshman's "Shoot" dance without credit, compensation or approval from BlocBoy. In the suit, he claims that while he hadn't registered a copyright on the dance when Fortnite used it, he's in the process of doing so now.

In the fall of 2018, JB expressed his frustrations with the video game on Twitter — despite initially being seemingly flattered at the imitation earlier in the year.

"EveryTime Somebody Does My Dance Dey Give Credit To @FortniteGame But Dey Ain’t Create Nothing But Da Game So Basically Dey Takin Money And Credit For My Shit Dats Crazy," he wrote in September.

Nearly three months later, BlocBoy contemplated taking legal action — likely inspired by rapper 2 Milly's similar lawsuit against the video game creators for the use of his dance, the Milly Rock.

Chance The Rapper has also spoken out on the issue, and though he has no moves that were taken for the game, he wants the Fortnite creators to pay his fellow artists.

"Fortnite should put the actual rap songs behind the dances that make so much money as Emotes," Chano wrote in one of a series of tweets. "Black creatives created and popularized these dances but never monetized them. Imagine the money people are spending on these Emotes being shared with the artists that made them."
