According to TMZ, Drake is being sued for illegally sampling a monologue from the 1982 song, “Jimmy Smith’s Rap” on his 2013 single “Pound Cake/Paris Morton Music 2” featuring Jay-Z.

Apparently Drake never received permission from Jimmy Smith’s Estate to use the song nor did he ask to do so. Along with Drake, the Estate is suing Cash Money Records and other who involved for over $300K.

The sample is used on the intro for the track and featured on Drake’s platinum selling album, Nothing Was the Same:

“Good God Almighty. Like back in the old days. You know, years ago they had the A&R men to tell you what to play, how to play it and you know whether it's disco and rock but we just went in the studio and we did it. We had the champagne in the studio, of course, compliments of the company, and we just laid back and did it. So we hope you enjoy listening to this album half as much as we enjoyed playing it for you. Because we had a ball. Only real music is gonna last, all the other bullshit is here today and gone tomorrow...”

Christian Rich, a twin producer and DJ duo, produced the intro to “Pound Cake/Paris Morton Music 2” and are assumed to be part of the “other” being sued by the Estate.

The actor turned rapper has yet to speak on his current legal drama, but until then you can find the artist preparing to host this year’s Espy Awards.—Morgan Murrell
