In 2013, North Texas teenager Ethan Couch was drunk driving along a rural road and was involved in an accident that left four people dead and two seriously injured. Instead of spending time in prison for the reckless offense, Couch was let off light with a sentence of ten years probation and time in a cushy rehab center. Couch's attorneys argued that the teen suffered from "affluenza," a controversial defense that said Couch was unable to link his bad behavior with consequences because of his parents teaching him that wealth buys privilege.

In 2014, Mack Maine spoke on the incident with his song "Ethan Couch." But instead of putting an image of Couch on the cover art, Maine used a photo of a different 17-year-old kid and are now being sued by the child's parents, Mark and Becky English, for misidentifying the child and associating him with Couch. According to TMZ, Maine is being sued for using the teen's likeness and Birdman has been named in the suit since the song was released under Cash Money.
