One of the four suspects charged killing XXXTentacion has filed a motion to have his police testimony thrown out of the case.

According to court documents obtained by XXL, Michael Boatwright—the suspect police believe to have fatally shot XXX during a robbery on June 18, 2018—filed a motion to suppress a statement he gave police after he was arrested last year.

In the newly filed documents, Boatwright’s lawyer claims that on July 5, 2018, his client was arrested on an unrelated drug charge and transported to the Broward Sheriff’s Office interrogation room after being named a suspect in the murder of XXX.

Boatwright's lawyer says the homicide detective began asking him a series of background questions about his identity. The attorney says that eight minutes into the questioning—which started before the officer finished reading Boatwright his Miranda Rights—Boatwright told the detective that he didn't want to continue the interview.

Boatwright's lawyer says police did not stop the interview and continued asking questions before having someone come into the room and take photos of Boatwright and collect the suspect's DNA. From there, the detective finished reading Boatwright his Miranda Rights. Despite Boatwright's resistance, the interview continued.

With this in mind, Boatwright's lawyer asserts that the detective violated the murder suspect's constitutional right to remain silent, and so, therefore, his testimony should be suppressed.

Boatwright is currently in jail awaiting his trial and is working diligently to build his defense in the case. Next month, the suspect plans to have XXXTentacion's mother Cleopatra Bernard, and the mother of X's son, Jenesis Sanchez, deposed.

Boatwright's attorney will take the depositions from Bernard, Sanchez and Leonard Kerr, a friend who accompanied X to the Riva Motorsports location that the rapper was shot outside of last year, next month. Boatwright will then use the depositions from both Bernard and Sanchez for his defense.
