Jay-Z and Kanye remain on the top of the charts, but not without a pending copyright infringement lawsuit from Chicago soul singer Syl Johnson.

According to the Huffington Post, Johnson is suing the duo for using his vocals on their Pete Rock-produced, Watch the Throne bonus cut, "The Joy," without permission.

Apparently, Def Jam and Johnson were in talks about clearing the sample when it appeared as part of West's G.O.O.D. Fridays music series, but when the song ended up on WTT, the crooner was left off the credits, preventing him from collecting any money.

The legendary artist is no stranger to copyright infringement lawsuits, tallying up his victories from fighting over sampling rights with iconic rappers and musicians including Wu-Tang Clan, Michael Jackson, Kid Rock and Cypress Hill (with whom he legally battled for 20 years).

Island Def Jam has not commented on the suit as of press time. –Rachelle Jean-Louis
