A model shot during the gunfire that erupted on Thursday (May 26) at a T.I. concert at Irving Plaza has plans to sue the New York City Police Department.

Maggie Heckstall, 26, was one of four people struck by gunfire while sitting in the VIP section. She was transported to Bellevue Hospital but not before getting unnecessarily interrogated by police police as she lie in agony, she feels. Her lawyers feel the same way too and plan to take legal action against the cops.

“[Police] want to investigate and we get that, but don’t make her life miserable because she took a stray bullet,” Heckstall's lawyer Emel McDowell told New York Post.

Cops have reportedly been posted outside of Heckstall's hospital room refusing to let non-hospital staff in. “We understand the NYPD is doing their job, but she’s not under investigation,” McDowell added. “She’s not in custody for the crime. She didn’t ask for police protection. She’s obviously a victim in this. They’re making her life worse by doing this.”

He continued, “The infringement upon Ms. Heckstall’s 4th Amendment right to be free from illegal search and seizure is emotionally draining for Ms. Heckstall and also an impediment to her speedy and full recovery.”

Even Heckstall, who is reportedly Maino's girlfriend, has taken to her Instagram account to post a statement on the whole situation. She claims she has no idea who shot her and as of yesterday had yet to make a statement to the police. "As for the NYPD being at my door and denying my visits was very uncalled for. I dont' need protection. The bullet was a stray and my family coming to see doesn't tamper with detectives investigation," she posted.

“We expect to be filing a claim against all responsible parties,” Heckstall's lawyer added.

Troy Ave has been arrested and charged in connection with the shooting that took the life of BSB affiliate Ronald McPhatter, 30. The Brooklyn rapper was captured on camera shooting off a gun in the venue.

Ave was also struck in the leg during the shooting. In one video captured of the incident a woman can be heard screaming about pain in her leg immediately after shots start to pop off.
