Following his arrest in Atlanta on for allegedly being an illegal immigrant this past Sunday (Feb. 3), 21 Savage is planning to fight for his right to stay in the U.S.  Charles H. Kuck, who works as one of the rapper's attorneys, says that's something he actually did quite a while ago.

On Monday (Jan. 4), Kuck told TMZ that ICE is "unnecessarily punishing" his client and intimidating him into leaving the country. He also maintains that there has been a misunderstanding with Savage’s visa status.

Kuck told the outlet that Savage applied for a U visa in 2017 and the application is still under review and Immigration and Customs Enforcement (ICE) knew about it but didn’t take any action until the rapper’s arrest this past weekend.

He explained that 21 applied for a U visa based on him being a victim of a crime. He said that Savage was shot during a 2013 incident where his best friend was murdered. According to Kuck, Savage was deeply affected by his friend's death, and, since he's a victim of a crime, that puts him in position for permanent residency in the U.S.

"As a minor, his family overstayed their work visas, and he, like almost two million other children, was left without legal status through no fault of his own," he added.

The attorney insists that Savage has no prior criminal charges, explaining that, although the 26-year-old pled guilty to felony drug possession in 2014, his conviction was erased from his record in September 2018.

Kuck is angry at ICE for detaining his client and doing what he feels is preventing him from taking care of his children. ICE plans to hold Savage for deportation proceedings scheduled for this week.

As we previously reported, U.K.-based publication The Daily Mail Online published Savage's birth certificate, which confirms that he was born at Newham Hospital in East London. The website also stated that the birth certificate also confirms that 21 lived in England for 12 years before moving to Atlanta.

Meanwhile, a slew of rappers have shown their support for 21 Savage, including Cardi B, who he collaborated with in 2017.
