It looks like Nelly is officially in the clear as far as his alleged rape case, as the King County Prosecutor’s Office in Washington has formally declined to file sexual assault charges against him.

According to Q13 Fox, the victim's attorney, Karen Koehler, released an official statement this week (Dec. 13), revealing that no charges would be formally filed against the St. Louis rapper.

"Our office has formally declined to file charges on this matter," the statement begins. "Police responded to and investigated a sexual assault allegation involving Mr. Haynes.  However, within days of her initial report to police, the complainant, through her attorney, informed investigators from the Auburn police department that she did not wish to assist in prosecution or the investigation of Mr. Haynes. While we have reviewed the existing investigative material, without the assistance of the complainant, this office is unable to proceed or fully assess the merits of the case."

If you recall, the alleged victim wanted prosecutors to drop the case back in October, admitting that she would not testify against Nelly. Following that statement, the victim supported authorities continuing their investigation, which left the rape case open.

Nelly was originally arrested for raping a woman after his concert in Auburn, Wash. back in October, and denied the case against him shortly after, claiming his innocence.
