Bobby Shmurda’s Bail Paperwork Is Withdrawn

Things aren't exactly going to plan for Bobby Shmurda. Less than a week after his plea hearing in the Manhattan Supreme Court last Thursday, the Brooklyn MC's legal team withdrew its $2 million bail application paperwork that could have seen Shmurda, real name Ackquille Pollard, released as early as this week. According to the NYC Department Of Corrections' web site, Shmurda's next court date will be tomorrow, Feb. 5, though with bail withdrawn it remains to be seen whether that date will still be honored.

Last Thursday, Shmurda appeared before a judge for the first time since his arrest Dec. 17 on conspiracy and related charges, where he pled not guilty to all counts. His attorney, Kenneth Montgomery, argued at the hearing that Shmurda's bail was "unfair" and that he'd be applying for a reduction; Judge James Burke replied that bail needed to be posted before a hearing could take place. The following day, Shmurda's legal team filed bail paperwork with the Special Narcotics Prosecutor's Office, which was expected to be approved or rejected within 72 hours. Now that the bail application has been withdrawn, SNP spokeswoman Kati Cornell indicated to the New York Times that no hearing is currently set.

While Shmurda remains locked up, his lawyer Montgomery continues to fight for his release, telling the Times that he is working on a new bail application and that he is hoping to submit the paperwork "within the next week." Just before the initial application was filed last Friday, Montgomery filled XXL in on what the procedure would be after paperwork is filed. "The government is going to look at it and see if they have issues with it. If they don’t have issue with it, he’ll be released, then they have to litigate it through a hearing," Montgomery said at the time. "Best case is that he’s out sometime next week, worst case is we do a hearing and the judge agrees with the Government and he stays in."

Shmurda was arrested in December along with 14 other members of his GS9 crew on what was initially 69 counts and indicted on Dec. 18 in a press conference spectacle spearheaded by NYPD Police Commissioner William Bratton. A superseding indictment was filed in January that upped the charges to 101 counts relating mostly to the "takedown" executed by the NYPD that resulted in the defendants' arrests and the discovery of an additional 10 guns and three defendants. The remaining defendants, including fellow Epic Records artist Rowdy Rebel, have their next court date set for Apr. 22.
