E-40 has sent a cease-and-desist letter to the author of a new book titled Captain Save A Hoe, claiming the novel infringes on his trademark of the phrase, TMZ reports. The news comes seven months after the "You and That Booty" rapper sued a different author for publishing a book with the same title, also the name of a song released by E-40 in 1993.

The book in question, written by CJ Miller, describes itself as "a peek into Christian's world of survival. Lies, lust, deceit, betrayal, and cold-bloodedness. Nothing will stop her pursuit of a lavish lifestyle." It is currently listed on Amazon internationally, but not in the United States.

TMZ reports that Miller is currently incarcerated, but his wife is fighting against E-40 although it appears that he has the legal high ground. According to the U.S. Patent and Trademark Office, the rapper born Earl Stevens owns three trademarks for the phrase, including one issued last October that covers "publications, namely, a series of novel books in the fields of urban fiction." The trademarks also cover the phrase's use in merchandise and entertainment media.

In addition to defending his copyright claims, hip-hop's foremost inventor of slang is due to release a new album this month. E-40's The Gift of Gab is scheduled to drop on June 29. The project comes on the heels of 40's joint project in April with his cousin B-Legit Connected and Respected.
