San Diego Rapper Brandon 'Tiny Doo' Duncan—who could face 25 years to life in prison—said on CNN last night (Jan. 22) that California prosecutors are "trying to eradicate Black men." Prosecutors say that Duncan should be behind bars because he is allegedly benefitting from gang violence and his violent lyric promotes it.

California Penal Code 182.5 makes it a felony for an individual to participate in a criminal street gang, or to benefit from gang activity, and provides for 25 years to life imprisonment for violators. Tiny Doo’s No Safety album is the main focus for prosecutors. They say his lyrics are guilty of breaking that code plus he's a gang member. CNN reports that the California MC is facing nine counts of criminal street gang conspiracy over allegations that he and his alleged gang members bolstered their stature with several shootings in 2013 and early 2014. Tiny Doo, pleaded not guilty to those charges in last month. The most shocking thing is that the rapper has no criminal record.

CNN Legal Analyst Mark Geragos says Duncan is probably being used as a example for other gangster rappers who "glorify or glamorize gang activity." Watch the interview with CNN's Don Lemon above.
