During a recent trip Fabolous made to Georgia, he was hit with a lawsuit filed by an Atlanta busboy named Octavious Butler.

According to the Atlanta Journal-Constitution, the suit was filed Monday (January 31) in Fulton County Superior Court where Butler claims that the New York rapper and an unknown man hit him with a glass bottle in the head and punched him at Atlanta’s Fox Sports Grill. According to the court papers, the “You Be Killin’ Em” spitter allegedly attacked Butler without being provoked.

The 31-year-old rapper has gotten into trouble previously. In October 2006, he was arrested for carrying an unlicensed gun. The following year the BK MC was suspected in the fatal stabbing of a childhood friend outside a Manhattan nightclub, although he denied being there. In February 2009, police discovered 500 pounds of weed on his tour bus, though the "Body Ya" star wasn’t aboard at the time.

As previously reported, The rapper will be releasing a new mixtape later this month called The S.O.U.L Tape.
